Cookie banner - Legally compliant use of cookies in pharmaceutical marketing

What is a cookie banner?
A cookie banner is a website interface that explains certain storage and access operations and, where necessary, requests consent. It can cover cookies, similar technologies and the associated purposes. A consent management solution often operates behind the interface.
Its purpose is to enable an informed, effective decision. A high acceptance rate alone does not establish quality. The choices, explanations and actual behavior of connected services need to agree.
When is consent required?
In Germany, section 25 TDDDG addresses storage of information on devices and access to information already stored. Exceptions particularly concern operations strictly necessary for a digital service expressly requested by the user. A website does not therefore need a consent banner simply because it uses technically necessary cookies.
Processing personal data also requires an appropriate GDPR legal basis. These are separate assessments. Cookieless operation does not automatically mean that consent or other privacy obligations are absent.
How should choices work?
Non-essential services that require consent should remain inactive until valid consent is given. Purposes and providers need understandable explanations; preselected approval is not an active choice. Refusal and later changes should be easy to find.
A notice with a close button cannot replace required consent. An attractive banner also fails its purpose when a tracking service receives data beforehand or withdrawal has no technical effect.
What matters on healthcare websites?
Disease-related pages can reveal sensitive interests. Teams should examine which page visits, form details and campaign information reach analytics or advertising services. Contact details, free-text entries and information about health status should not enter tracking events without proper assessment.
Practical checks cover acceptance, refusal, later changes and withdrawal. Actual network behavior matters. New plugins, embedded videos and marketing services need to be reflected in configuration and privacy information.
Conclusion: Choices and information flows must agree
A cookie banner is one element of a privacy framework. It should explain and enforce the consent decisions that are required. Selecting a particular software product or banner design does not itself guarantee compliance.
